DRAFT — NOT LEGALLY REVIEWED. DO NOT PUBLISH AS-IS.
This document was drafted as a working starting point. It has not been reviewed by a solicitor, and it contains [[CONFIRM: …]] placeholders wherever a fact was not available. Every placeholder must be filled and the whole document reviewed by a qualified adviser before OlaDoc.ie accepts a single order. Publishing this unchanged would misstate your legal position to patients.

1. About these terms
These terms govern your use of OlaDoc.ie and your purchase of at-home test kits. By placing an order you accept them. Please read section 4 carefully — it sets out what this service is not.
OlaDoc.ie is operated by IE HEALTHNOW LIMITED, company number 805729, registered office 5 St Patrick’s Close, Kilkenny, Ireland [[CONFIRM: Eircode]]. Contact: [[CONFIRM: support email]].
2. Eligibility
To use this service you must be [[CONFIRM: minimum age, typically 18]] or over, resident in the Republic of Ireland, and ordering for yourself. You may not order on someone else’s behalf without [[CONFIRM: policy on third-party ordering]].
3. What you are buying
Each order comprises: an at-home sample collection kit; laboratory analysis of the sample you return; and review and interpretation of your results by a doctor registered with the Irish Medical Council. GP review is included in the price and is not optional or separately purchasable.
4. What this service is not
This matters more than anything else in these terms.
- Not a diagnosis. Test results are a screening tool. A normal result does not exclude disease; an abnormal result does not by itself confirm it.
- Not a replacement for your GP. We do not hold your medical history, cannot examine you, and do not manage ongoing conditions.
- Not an emergency service. We do not monitor for urgent results around the clock. If you are seriously unwell, contact your GP, attend an emergency department, or call 112 or 999.
- Not a prescribing service. [[CONFIRM: whether any prescribing follows from results, or whether all treatment is referred out. This materially changes the regulatory position.]]
5. Your responsibilities
The accuracy of your result depends substantially on you. You agree to:
- Give accurate and complete information when registering your kit, including medication and supplements
- Follow the sampling instructions, including fasting, timing of day, and cycle timing where these apply
- Register your kit’s unique reference number before posting it
- Post your sample promptly, and avoid posting immediately before a weekend or public holiday
If a sample is unusable because instructions were not followed, [[CONFIRM: replacement kit policy — free replacement, discounted, or chargeable]].
6. Samples that cannot be processed
Samples are sometimes rejected: insufficient volume, haemolysis, degradation in transit, or an unregistered reference number. Where this happens through no fault of yours, we will [[CONFIRM: replacement/refund policy for failed samples]].
7. Results and turnaround
[[CONFIRM: turnaround time, once agreed with the laboratory. Do not publish a figure until it is contractually committed — a published turnaround becomes a term of the contract.]]
Turnaround times are estimates from receipt of your sample at the laboratory, not from the date you order. Postal times are outside our control.
8. Prices and payment
Prices are in euro and shown on each product page. Payment is taken at checkout via Stripe. [[CONFIRM: VAT treatment of diagnostic test kits in Ireland, and whether displayed prices are inclusive. This needs an accountant’s answer.]]
Delivery within the Republic of Ireland is included in the price.
9. Cancellation and returns
See our separate Returns and Refunds policy. In summary: you have a 14-day right to cancel under the Consumer Rights Act 2022, but that right is lost once a sealed kit has been unsealed, for health protection and hygiene reasons.
10. Liability
[[CONFIRM: liability wording must be drafted by a solicitor. Consumer contracts in Ireland cannot exclude liability for death or personal injury caused by negligence, and unfair-terms rules limit what can be excluded. Boilerplate copied from a non-Irish site is likely to be unenforceable and may itself breach consumer protection law.]]
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
11. Clinical governance and complaints
Our reviewing doctors are registered with the Irish Medical Council and are subject to its professional standards. If you are unhappy with the clinical care you received, contact [[CONFIRM: complaints email]]. [[CONFIRM: complaints procedure, escalation route, and response timeframe.]]
12. Governing law
These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction. As a consumer you retain the protection of mandatory provisions of the law of your country of residence.
